根据《中华人民共和国民法典》及其他有关的规定，为明确甲、乙双方的权利和义务的关系，经双方协商一致，签订本合同。
第一条、房屋基本情况
甲方将自有的坐落于___市___街___巷___号的房屋___栋___间，建筑面积___*方米、使用面积___*方米，类型___，结构等级___，完损等级___，主要装修设备___，出租给乙方作___使用。
第二条、租赁期限
租赁期共___个月，甲方从___年___月___日起将出租房屋交付乙方使用，至___年___月___日收回。
乙方有下列情形之一的，甲方可以终止合同，收回房屋：
1.擅自将房屋转租、分租、转让、转借、联营、入股或与他人调剂交换的;
2.利用承租房屋进行非法活动，损害公共利益的;
3.拖欠租金__个月或空置__月的。
合同期满后，如甲方仍继续出租房屋的，乙方拥有优先承租权。
租赁合同因期满而终止时，如乙方确实无法找到房屋，可与甲方协商酌情延长租赁期限。
第三条、租金和租金交纳期限、税费和税费交纳方式

修缮范围和标准按城建部(87)城住公字第13号通知执行。
甲方修缮房屋时，乙方应积极协助，不得阻挠施工。
出租房屋的修缮，经甲乙双方商定，采取下述第___款办法处理：
1.按规定的维修范围，由甲方出资并组织施工;
2.由乙方在甲方允诺的'维修范围和工程项目内，先行垫支维修费并组织施工，竣工后，其维修费用凭正式发票在乙方应交纳的房租中分___次扣除;
3.由乙方负责维修;
4.甲乙双方议定。
乙方因使用需要，在不影响房屋结构的前提下，可以对承租房屋进行装饰，但其规模、范围、工艺、用料等均应事先得到甲方同意后方可施工。对装饰物的工料费和租赁期满后的权属处理，双方议定：
工料费由___方承担(___);

第五条、租赁双方的变更
1.如甲方按法定手续程序将房产所有权转移给第三方时，在无约定的情况下，本合同对新的房产所有者继续有效;
2.甲方出售房屋，须在______个月前书面通知乙方，在同等条件下，乙方有优先购买权;
3.乙方需要与第三人互换用房时，应事先征得甲方同意，甲方应当支持乙方的合理要求。
第六条、违约责任
1.甲方未按本合同第一、二条的约定向乙方交付符合要求的房屋，负责赔偿___元。
2.租赁双方如有一方未履行第四条约定的有关条款的，违约方负责赔偿对方___元。

第一条租赁期限
（一）房屋租赁期自20___年____月____日至20____年___月____日，共计1年。房屋经甲乙双方交验签字盖章并移交房门钥匙以后视为交付完成。

第四条转租

第五条合同解除

（二）因不可抗力导致本合同无法继续履行的，本合同自行解除。
第六条其他约定事项
1. 水电费、电视收视费、小区卫生费、液化气费由乙方自付
2.房屋交付使用时应确保房屋建筑结构安全可靠，门、窗完好，上、下水通畅，供电正常，太阳能设备能正常使用，歌华有线（电视信号）正常使用。
3.乙方不能对屋内隔墙进行拆除。如果乙方自行修改房屋结构，所产生。
4.水电费、电视收视费、小区卫生费、物业管理费、液化气费等等由乙方自付。
5.乙方租用期间如发生任何意外由乙方自己负责，甲方不承担任何责任和赔偿_
第七条违约金和违约责任
1、若出租方在承租方没有违反本合同的情况下提前解除合同或租给他人，视为出租方违约，负责赔偿违约金_____元。

2. 房屋设施如因质量原因、自然损耗或灾害而受到损坏，甲方有修缮并承担相关费用的责任。

3. 甲方应确保出租的房屋享有出租的权利，反之如乙方权益因此遭受损害，甲方应负赔偿责任。

七、乙方义务 obligations of party b
1. 乙方应按合同的规定按时支付定金、租金及保证金。

根据《中华人民共和国民法典》及有关规定，为明确甲、乙双方的权利义务关系，经双方协商一致，签订本合同。
第一条 甲方将自有的坐落在_________（以下简称本房产）_________层_________号房，建筑面积为_________*方米，公寓类型属于_________；出租给乙方使用。
（本合同所指的公寓类型是标房／单人房、商务房（甲型）、商务房（乙型）、双套房四种）
第二条 租赁期限
双方约定本房产的租赁期为_________年，暂定从_________年_________月_________日起到_________年_________月_________日。每年的_________月_________日至次年_________月_________日为一个出租年度。

第三条 房屋交验

第四条 房屋租赁使用管理

第五条 租金支付时间及方式

第六条 甲方权益
1．在租赁期内，甲方所出租的每套公寓每年享有免房费使用同类型_________套公寓_________天的权利，在这期间，甲方不需交纳房费、服务费。免房费住宿期不包括元旦、五一、国庆节、春节、双休日等国家法定节假日以及根据**通知的节假日的调整日。上述免房费住宿期，甲方有权选择在乙方及经乙方认可的相关企业在国内其他著名风景区开发或连锁的同档次度假酒店使用，同时享有本条第2项约定之优惠权益，具体可享用的酒店及可享用的天数，以乙方的书面通知为准。
2．在免房费住宿期之外，甲方凭乙方发放的会员卡同时享有下列优惠折扣房价：_________。乙方将根据市场的变化及季节的更替适时修订业主优惠计划，并据此制订优惠措施，乙方将通过信函或网站、或电话形式告知，由此引起与上述条款不一致的，甲方无异议，但乙方应充分保证甲方可以享受超过普通客户的价格优惠。
3．_________天的同类型公寓免房费住宿期间，若甲方自行组织客户入住，酒店实际收取的房费在扣除20％的相关税费及服务费后，剩余部分由乙方返还给甲方。

5．甲方享有上述第1项、第2项、第3项权益，可以指定或授权任何第三方享受，以持有乙方发放的会员卡为准。
上述第3项、第4项由乙方返还给甲方的金额随租金一起支付，支付方式与房屋租金支付方式一样。
第七条 租赁期间的房屋修缮和装修。
修缮房屋由乙方负责。修缮范围和标准按***有关规定执行。
乙方因使用需要，可以对承租房屋进行装修，但不得损坏房屋主体结构，影响楼宇安全。所有装修费用由乙方承担，租赁期满后，所有权归属甲方。
第八条 租用期间的房屋使用管理
在本合同的租赁期内，甲方房屋的管理权委托乙方行使，乙方的合法经营行为和措施不受甲方干预，但乙方不得因自身委托单位的原因，影响甲方的收益。
租赁期内，乙方经营中所发生的管理费和经营费用均由乙方承担。
第九条 租赁双方的变更
1．如甲方按法定程序将房屋所有权转移给第三方（包括合法继承人和其他权利人）时，甲方有义务告知该第三方有关本房产的租赁事实及全部详细情况，本合同对新的房产所有者继续有效；
2．甲方出售房屋必须提前一个月以书面形式通知乙方，在同等条件下，乙方有优先购买权。
第十条 房屋户内设备设施的维护、更新
甲方出租给乙方的公寓，配有全套家俱和装饰（具体情况见合同附件《装修配备表》）。租赁期间内，由乙方负责户内家俱和用品的`维护、保养及易耗品更新，并承担相应费用。
本合同终止之日，乙方应无条件返还甲方公寓内全套家俱和用品，但对装修及物品正常使用年限内的折旧，乙方不负更新责任。
第十一条 违约责任
1．乙方逾期交付租金，除仍应补交欠租外，并按当期欠付租金的万分之五乘以逾期天数向甲方计付违约金。
2．由于甲方转移户内有关物品或未经乙方同意而采取其他方式提前收回本房产，致使本合同所约定的租赁关系中断，视为甲方违约。甲方应以相当于当期年租金三倍的标准作为违约金支付给乙方，乙方有权要求甲方继续履行合同。若乙方同意解除合同，因双方租赁关系中断，乙方不再承担本合同及相关协议应尽的责任。
上述违约行为的经济索赔事宜，由甲、乙双方协商，协商不成，按第十五条约定的方式处理争议。
第十二条 合同的解除
1．租赁期间，乙方有下列情形之一的，甲方有权终止合同，收回本房产。
（1）擅自将房屋转让，对外投资入股或与他人调换；
（2）利用承租房屋进行非法活动，损害社会公共利益的；
（3）乙方未按约定期限支付租金超过四个月。
若甲方依上述第1、2、3项约定而解除合同，乙方须按相当于年租金三倍标准作为赔偿金一次性支付给甲方。
2．关于提前终止合同的其他约定，按以下条款处理：租赁期限内，如甲方与_________公司签订的《商品房买卖合同》经法定机关依法撤销或双方协商解除合同，而致本合同无法继续履行，则双方在结清实际租赁期内的租金后，互不追究对方责任。若甲、乙双方依约定解除或依法终止合同后，乙方不再承担包括支付租金在内的本合同约定的任何义务。
第十三条 送达条件
1．为保证乙方向甲方及时有效送达有关事项的通知以及准确及时付款，甲方须提供其便捷、准确的通讯联络方式与收款账户等个人资料。因甲方提供的个人资料有误或变更未及时书面告知乙方造成的损失及其他责任由甲方自行负担。
2．若甲方提供的收款帐户是非本市帐户，又要求乙方电汇支付的，电汇手续费由甲方承担，在支付时扣除。
3．甲方要求免房费住宿的，必须以书面形式（函寄或传真）提前3天通知乙方。
第十四条 免责条件
房屋如因不可抗力（包括诸如天灾、战争等等）导致损毁或造成双方损失的，甲乙双方互不承担责任。由此而导致合同终止的，租金按乙方实际租用时间计算，多退少补。
第十五条 争议解决方式
本合同在履行中如发生争议，双方应协商解决，协商不成时，向有管辖权的人民法院提起诉讼。
第十六条 本合同未尽事宜，甲、乙双方可共同协商，签订补充协议。该补充协议与本合同具有同等效力。
第十七条 本合同一式叁份，甲、乙双方各执一份，公证处备案一份。
第十八条 合同的生效

双方按有关政策规定精神，协商议定事项如下：
一、乙方应依约按期向甲方交付租金，不得拒交或拖欠。
